AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

The 79th Legislature, Regular Session, 2005, enacted legislation that created a county court at law for Cass County.  The judge of this court is required to give preference to juvenile cases and is to be included as a member of the county's juvenile board.  However, there is conflict between Sections 152.0032 (Composition of Juvenile Board) and 152.0401 (Cass County), Human Resource Code, regarding the composition of the juvenile board, potentially leaving the role of the county court judge in question. 

 

H.B. 1500 includes the judge of the County Court at Law of Cass County as a member of the Cass County Juvenile Board. 

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 152.0401(a), Human Resources Code, by including the judge of the County Court at Law of Cass County in the composition of the Cass County Juvenile Board.

 

SECTION 2.  Effective date: upon passage or the 91st day after adjournment.
