BACKGROUND AND PURPOSE

 

Currently, the Transportation Code allows for a county or municipality to restrict overnight parking of commercial vehicles in a residential subdivision upon request from homeowners.  The current language does not apply to adjacent streets.  Overnight parking of commercial vehicles continues to provide disturbances for residents, while obstructing driving lanes and access to neighborhood parks, schools and churches.

 

CSHB 1522 expands existing provisions regarding the restriction of overnight parking in a residential subdivision to apply to streets adjacent to a subdivision and within 1,000 feet of a residence, school, church or park.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

SECTION 1.  Amends the heading of Section 545.307 of the Transportation Code, by adding language to expand the Section to apply to area near a residential subdivision.

 

SECTION 2. Amends Section 545.307 of the Transportation Code by adding language to include a street adjacent to a subdivision and within 1,000 feet of the property line of a residence, school, church, or park.   Specifies that the section applies only to streets maintained by a county or municipality.

 

SECTION 3.  The Act takes effect September 1, 2007.

September 1, 2007.

Substitute adds language that specifies that the changes in statute only apply to streets that are maintained by a county or municipality.
