BACKGROUND AND PURPOSE

 

As proposed, C.S.H.B. 1638 amends the geographical thresholds  that determine the eligibility of a police officer in certain municipalities to become certified by the Department of Public Safety to enforce commercial motor vehicle safety standards.   

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

SECTION 1.  Amends Section 644.101(b), Transportation Code, to set forth that a police officer in a municipality with a population of less than 5,000 that is located: adjacent to a bay connected to the Gulf of Mexico; and in a county adjacent to a county with a population greater than 3.3 million is eligible to apply for certification.

 

SECTION 2.  Effective date: September 1, 2007.

COMPARISON OF ORIGINAL TO SUBSTITUTE

 

C.S.H.B. 1638 is different from the bill as originally filed by amending the population requirement from 3.5 million to 3.3 million in Section 644.101(b) of the Transportation Code.
