BACKGROUND AND PURPOSE

 

In the 78th Legislative Session, Section 568 of the Occupations Code was amended to allow certain pharmacies to have at least one pharmacist for every five pharmacy technicians, instead of the standard ratio of at least one pharmacist for every three pharmacy technicians.  HB 1683 would repeal section 586.006 thereby restoring the standard ratio of at least one pharmacist for every three pharmacy technicians for Class A pharmacies.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

HB 1683 repeals Section 568.006, RATIO OF PHARMACISTS TO PHARMACY

TECHNICIANS, of the Occupations Code. This provision provided that the ratio of pharmacists to pharmacy technicians in a Class A pharmacy must be at least one pharmacist for every five

pharmacy technicians if the Class A pharmacy dispenses not more than 20 different prescription drugs and does not produce intravenous or intramuscular drugs on-site.

September 1, 2007.
