BACKGROUND AND PURPOSE

 

Under current statute, an appeal bond must contain certain recitations. However, identifying information is not included in these requirements. Appeal bonds are currently sent to the county clerk without this information, delaying the process. Adding the requirement for name, date of birth, and driver’s license or personal identification certificate number, if available, to be included in the appeal bond recitations would expedite the processing.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

House Bill 1687 amends the Code of Criminal Procedure to provide that an appeal bond must state the defendant's name, date of birth, and driver's license or personal identification certificate number, if available.  Makes application of this Act prospective.

 

EFFECTIVE DATE

 

September 1, 2007.
