BACKGROUND AND PURPOSE
The purpose of House Bill No. 1694 is to simply clarify the boundaries of the Airline Improvement District (the “District”). The District was created by legislation enacted during the Regular Session of the 79th Texas Legislature (House Bill No. 1478).
The District is funded through a 1% sales tax issued within its boundaries. An election for the sales tax was held September 10, 2005, where the voters within the District overwhelmingly approved the tax. After approval of the sales tax, District officials met with staff of the State Comptrollers office to determine the businesses that would be required to charge the 1% sales tax. It was during these discussions that District officials determined that a boundary survey should be prepared in the District to carry out the intent of House Bill No. 1478, which was to include all businesses on Airline Drive and Aldine Mail Road. The boundary survey will also avoid any confusion as to what the boundaries of the District are as new development occurs.
RULEMAKING AUTHORITY
This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.
SUMMARY ANALYSIS
House Bill No. 1694 amends Section 2, Chapter 572, Acts of the 79th Legislature, Regular Session, 2005 to clearly define the Boundaries of the Airline Improvement District. The bill lays out the boundaries of the district as determined by professional surveys.
EFFECTIVE DATE
This Act would take effect immediately if it receives the necessary 2/3rds vote of the membership of each house of the Legislature. If it receives less than that margin, it takes effect September 1, 2007.
