BACKGROUND AND PURPOSE

 

H.B. 1, Acts of the 79th Texas Legislature, Third Called Session, created the Texas Governor’s School and placed the program in the governing statutes for the Texas Education Agency (TEA). Afterward, legislative leadership agreed that it made more sense for the program to be administered by the Texas Higher Education Coordinating Board rather than TEA. 

 

As proposed, HB 1748 repeals the Texas Governor’s School program from TEA’s statutes and places administration of the program in the Texas Higher Education Coordinating Board’s statutes to reflect current practice and legislative intent.

 

 

RULEMAKING AUTHORITY

 

It is the opinion of the committee that rulemaking authority is expressly granted to the Texas Higher Education Coordinating in Section 1 (Section 61.07621) of this bill.

 

 

ANALYSIS

 

Section 1. Transfers Section 29.124, Education Code, to Subchapter C, Chapter 61, Education Code, to be redesignated as Section 61.07621, Education Code. Strikes text regarding the definition of "public college or university" that becomes redundant under the new section, and makes conforming changes reflecting the governance of the Texas governor's schools by the Texas Higher Education Coordinating Board, rather than the Texas Commissioner of Education.

 

Section 2. Transfers all authority and duties regarding Texas governor's schools of the Texas Commissioner of Education to the Texas Higher Education Coordinating Board. Also transfers all money appropriated for Texas governor's schools from the Texas Education Agency to the Texas Higher Education Coordinating Board.

 

Section 3. Effective date.

 

 

EFFECTIVE DATE

 

Upon passage, or, if the Act does not receive the necessary vote, the Act takes effect September 1, 2007.
