BACKGROUND AND PURPOSE

 

Under current law, an applicant for a concealed handgun license must complete a handgun proficiency course and obtain a handgun proficiency certificate as a part of the application requirements.  A concealed handgun license expires on the first birthday of the license holder occurring after the fourth anniversary of the date of issuance and every five years thereafter. A license holder must complete a continuing education course and obtain certification in order to renew their license.

 

H.B. 1839 provides that, after the second license renewal, concealed handgun license holders would only be required to take a continuing education class and obtain a handgun proficiency certificate once every ten years rather than upon every five-year renewal. Fees and photographs would be required at each renewal.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

SECTION 1

The bill amends Government Code Section 411.185 to provide that a concealed handgun license holder must complete a continuing education course and obtain a handgun proficiency certificate within six-months of applying to renew their license for the first or second renewal and then within six months of applying for third and subsequent renewals while only requiring a continuing education course and certification once within a ten-year period.

 

SECTION 2

The changes made by this Act apply only to a license renewed on or after the effective date of this Act.
