AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

The office of the county attorney in Brown County (office) is primarily funded by hot check collection fees.  With banking technology continually advancing, allowing merchants to institute on-site check verification, it is likely that hot check collection revenue will substantially decrease in the coming years.  Currently, the office is only permitted to accept gifts of tangible items, rather than monetary donations.

 

H.B. 1930 allows the county attorney of Brown County or the Commissioners Court of Brown County to accept gifts or grants from individuals, partnerships, corporations, trusts, foundations, associations, or governmental entities for the purpose of financing or assisting the operation of the office.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Subchapter B, Chapter 45, Government Code, by adding Section 45.125, as follows:

 

Sec. 45.125.  BROWN COUNTY.  Authorizes the county attorney of Brown County or the Commissioners Court of Brown County to accept gifts or grants from any individual, partnership, corporation, trust, foundation, association, or governmental entity for the purpose of financing or assisting the operation of the office of county attorney in Brown County.  Requires the county attorney to account for and report to the county auditor all gifts and grants accepted under this section.

 

SECTION 2.  Effective date: upon passage or September 1, 2007.
