AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Current law allows cities that meet certain criteria to seek certification to perform commercial motor vehicle safety inspections.  However, Round Rock is a city that does not currently meet this criteria.  It is important for Round Rock to be able to seek such certification because there is a great amount of commercial traffic on Interstate 35, which runs directly through Round Rock. 

 

The Department of Public Safety (DPS) is responsible for certifying police officers for enforcing commercial motor vehicle safety standards.  DPS recovers its costs for such enforcement from the municipality or county that employs the officers.  Therefore, there would no fiscal impact to the state if this law became more inclusive.

 

H.B. 2077 authorizes a city with a population of 60,000 or more, any part of which is located in a county with a population of 750,000 and two or more counties with a combined population of one million or more, to seek certification to perform commercial motor vehicle safety inspections. 

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 644.101(b), Transportation Code, to include that a police officer of a municipality with a population of 60,000 or more any part of which is located in a county with a population of 750,000 or more and two or more counties with a combined population of one million or more is eligible to apply for certification under this section (Commercial Motor Vehicle Safety Standards).  Makes nonsubstantive changes.

 

SECTION 2.  Effective date: upon passage or September 1, 2007.
