BACKGROUND AND PURPOSE

 

Current law requires that a municipality have a population over 100,000 or cross into a county with a population of more than one million to qualify for certification to perform Commercial Motor Vehicle Safety inspections.

 

H.B. 2077, as proposed, would allow a police officer from a municipality with a population of 60,000 or more, any part of which is located in a county with a population of 750,000 or more, and any part of which is located in two or more counties with a combined population of one million or more.  This would allow additional municipalities to qualify for certification to perform Commercial Motor Vehicle Safety inspections.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

H.B. 2077 amends Transportation Code Section 644 to state that a police officer of a municipality with a population of 60,000 or more, any part of which is located in a county with a population of 750,000 or more, and any part of which is located in two or more counties with a combined population of one million or more, is eligible to apply for certification to enforce commercial motor vehicle safety standards.  Conforming changes are also made throughout the bill.

September 1, 2007
