AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Persons who have one set of license plates issued for a vehicle used by persons with disabilities may receive one disabled placard for use in their automobiles.  Two disabled parking placards are issued if the person does not receive any license plates issued for a vehicle used by persons with disabilities.  However, provisions for disabled placards are not specified for persons with license plates issued to certain veterans with disabilities.

 

H.B. 2105 entitles certain veterans with a disability to register two motor vehicles for two sets of special license plates and authorizes the veteran to receive two disabled parking placards.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 504.202, Transportation Code, by amending Subsections (b) and (d) and adding Subsection (g), as follows:

 

(b)   Entitles a veteran of the United States armed forces to register, for the person's own use, two motor vehicles under this section if the person has suffered a disability as a result of military service, the person receives compensation from the United States because of the disability, and the motor vehicle is owned by the person, and has a manufacturer's rated carrying capacity of two tons or less. Deletes existing text requiring the Texas Department of Transportation to issue a specialty license plate for a motor vehicle that has a manufacturer's rated carrying capacity of two tons or less and that is owned by a veteran of the United States armed forces.  Makes a nonsubstantive change.

 

(d)  Provides that a statement by the veterans county service officer of the county in which a vehicle described by Subsection (c), rather than Subsection (b), is registered or by the Department of Veterans Affairs that a vehicle is used exclusively to transport veterans with disabilities without charge is satisfactory proof of eligibility for an organization.

 

(g)  Authorizes a person who receives two sets of license plates under this section to receive two disabled parking placards under Section 681.004 without providing additional documentation.

 

SECTION 2.  Amends Section 681.004(a), Transportation Code, to authorize a person with a permanent disability to receive two disabled parking placards, if the person receives two sets of special license plates under Section 504.202.

 

SECTION 3.  Effective date: upon passage or September 1, 2007.
