BACKGROUND AND PURPOSE

 

Currently, Section 29.202(a), Education Code, provides that a student is eligible to receive a public education grant or to attend another public school in the district in which the student resides if the student is assigned to attend a public school campus at which 50 percent or more of the students did not perform satisfactorily on an assessment instrument administered under Section 39.023 (a) or (c) of the Education Code in any two of the preceding three years; or that was, any time in the preceding three years, considered academically unacceptable under Section 39.132 of the Education Code.

 

This bill makes the determination of eligibility under Section 29.202(a) simpler to determine by striking the first criterion above, and also lessens the amount of time (from the preceding three years to the preceding two years) in which campuses are tied to an unacceptable accountability rating.  This will help campuses that have addressed and corrected performance issues.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

Currently, one of the criteria under Section 29.202(a), Education Code, for determining student eligibility to receive a public education grant or to attend another public school in the district is if the student is assigned to attend a public school campus at which 50 percent or more of the students did not perform satisfactorily on an assessment instrument administered under Section 39.023(a) or (c), Education Code, in any two of the preceding three years.  This bill strikes that criterion.

 

This bill also amends the remaining eligibility criterion under Section 29.202(a), Education Code, to provide that a student is eligible to receive a public education grant or to attend another public school in the district in which the student resides if the student is assigned to attend a public school campus that was, at any time in the preceding two years, considered academically unacceptable under Section 39.132, Education Code.

 

The bill provides that the Act applies beginning with the 2007-2008 school year.

 

EFFECTIVE DATE

 

Upon passage, or, if the Act does not receive the necessary vote, the Act takes effect September 1, 2007.

 

COMPARISON OF ORIGINAL TO SUBSTITUTE

 

The original bill provided that that a student is eligible to receive a public education grant or to attend another public school in the district in which the student resides if the student is assigned to attend a public school campus that was considered academically unacceptable under Section 39.132, Education Code, during the preceding school year.  The substitute provides that a student is eligible to receive a public education grant or to attend another public school in the district in which the student resides if the student is assigned to attend a public school campus that was, at any time in the preceding two years, considered academically unacceptable under Section 39.132, Education Code.
