AUTHOR'S / SPONSOR'S STATEMENT OF INTENT
Victims of domestic violence often need access to the most basic and necessary resources in order to start a new life. Non-profits and other organizations help these individuals by providing assistance for these essential resources. Victims are sometimes required to submit written documentation to prove their status as victims of domestic violence in order to receive this assistance.
C.S.H.B. 2210 eliminates a barrier for victims seeking aid by providing them with a free copy of certain information contained within the report upon their request.
RULEMAKING AUTHORITY
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Chapter 2, Code of Criminal Procedure, by adding Article 2.30, as follows:
Art. 2.30. REPORT CONCERNING CERTAIN ASSAULTIVE OR TERRORISTIC OFFENSES. (a) Provides that this article applies only to certain offenses set forth in this subsection.
(b) Requires a peace officer who investigates the alleged commission of an offense listed under Subsection (a) to prepare a written report that includes the information required under Article 5.05(a) (Reports and Records).
(c) Requires the local law enforcement agency responsible for investigating the commission of the offense, on request of a victim of an offense listed under Subsection (a), to provide the victim, at no cost to the victim, with any information that is contained in the written report prepared under Subsection (b); described by Article 5.05(a)(1) or (2); and not exempted form disclosure under Chapter 552 (Public Information), Government Code, or other law.
SECTION 2. Amends Article 5.05, Code of Criminal Procedure, by adding Subsection (f), to require the local law enforcement agency responsible for investigating the incident to provide the victim, at no cost to the victim, with any information that is contained in the written report prepared under Subsection (a); described by Subsection (a)(1) or (2); and not exempted from disclosure under Chapter 552, Government Code, or other law.
SECTION 3. Effective date: September 1, 2007.
