AUTHOR'S / SPONSOR'S STATEMENT OF INTENT
In 1979, the 66th Legislature passed the Professional Prosecutors Act. The purpose of the Act was to encourage felony prosecutors to concentrate on their work for the state. The Act contains salary guarantees for state and county prosecutors in certain districts.
H.B. 2288 includes the district attorney of the 109th Judicial District in the list of district attorneys to whom the professional prosecutors law is applicable.
RULEMAKING AUTHORITY
This bill does not expressly grant any additional rulemaking authority to any state officer, institution, or agency.
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Section 46.002, Government Code, as follows:
Sec. 46.002. PROSECUTORS SUBJECT TO CHAPTER. Provides that the district attorney of the 109th Judicial District (district) is among the district attorneys to whom this chapter (Professional Prosecutors) applies.
SECTION 2. Amends Section 46.002, Government Code, effective January 1, 2009, to make a conforming change.
SECTION 3. Amends Section 43.150, Government Code, as follows:
Sec. 43.150. 109TH JUDICIAL DISTRICT. Deletes existing text authorizing the commissioners courts of the counties comprising the district to supplement the state salary of the district attorney in an amount not to exceed $2,000 a year. Deletes existing text requiring the commissioners court to pay a proportionate share of the supplemental salary according to the population of the county.
SECTION4. Effective date: September 1, 2007.
