BACKGROUND AND PURPOSE

 

The Victoria County Navigation District was established in February 1947 under the provisions of Article 16, Section 59 of the Constitution of the State of Texas as well as various statutes existing at that time. Since its inception it has been composed of a three (3) member board appointed by the Victoria County Commissioners’ Court.

 

Because of Board tenure and length of terms as well as the complexity of the issues dealt with on a daily basis a three (3) member Board is no longer practical. 

 

As proposed, H.B. 2368 increases the number of navigation and canal commissioners on the board from three to five.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

Section 1. Amends Subtitle A, Title 5, Special District Local Laws Code by adding Chapter 5005. Defines "Board" and "District", and establishes the composition of the board as five navigation and canal commissioners appointed by the Commissioners Court of Victoria County.

 

Section 2. Preserves existing board commissioners in their position until the expiration of their present term, and requires the Victoria County Commissioner's Court to appoint the necessary number of commissioners to the board as soon as possible.

 

Section 3. Effective date.

 

EFFECTIVE DATE

 

Upon passage, or, if the Act does not receive the necessary vote, the Act takes effect September 1, 2007.
