BACKGROUND AND PURPOSE

 

The Court of Criminal Appeals appoints a lawyer to represent the state in cases before the court and in other matters, and this lawyer is known as the state prosecuting attorney. This person is not currently subject to the professional prosecutors law. The purpose of this bill is to make the state prosecuting attorney subject to the law.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

The act would amend the Government Code to include the state prosecuting attorney among the persons to whom the professional prosecutors law applies. This would include a provision which entitles the state prosecuting attorney to at least $22,500 per year for office expenses.

 

EFFECTIVE DATE

 

September 1, 2007.
