AUTHOR'S / SPONSOR'S STATEMENT OF INTENT
Currently, the Texas Education Agency provides that a student is to receive an excused absence from school if the student has to make a court appearance. However, it is not among the five reasons a student may be absent from class and still considered present for the day for funding purposes.
H.B. 2455 requires that a student who is required to make a court appearance, including days absent from school due to traveling for this purpose, receive an excused absence. This allows school districts to receive attendance funding when students are absent from school because they are required to attend court.
RULEMAKING AUTHORITY
This bill does not expressly grant any additional rulemaking authority to any state officer, institution, or agency.
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Section 25.087, Education Code, by amending Subsection (b) and adding Subsection (c), as follows:
(b) Requires a school district to excuse a student from attending school for the purpose of travel for certain listed purposes, and includes attending a required court appearance as a purpose for which a student is to be excused from attending school. Makes conforming changes.
(c) Creates this subsection from existing text. Makes conforming changes.
SECTION 2. Makes application of the Act prospective to the 2007-2008 school year.
SECTION 3. Effective date: upon passage or September 1, 2007.
