BACKGROUND AND PURPOSE

 

Under current statute the hazardous duty pay that full-time correctional officers receive for a particular month is the lesser of $10 for each 12-month period of lifetime service credit accrued by the employee or $300.

 

House Bill 2498 increases the amount of hazardous duty pay that a full-time correctional officer employed by the Texas Department of Criminal Justice may receive from $10 to $12 for each 12-month period of lifetime service credit accrued by the employee, unless this amount exceeds $300. 

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

SECTION 1.  Amends Section 659.305 of the Government Code by amending Subsections (a), (d), (e), (f), and (g) and adding Subsection (h).

 

Subsection (a) adds full-time correctional officers to the list of exceptions from full-time state employees who receive hazard duty pay for a particular month at the lesser of $10 for each 12-month period of lifetime service credit accrued by the employee or $300.

                       

Subsection (d) adds full-time correctional officers to the list of state employees for whom  the number of 12-month periods of lifetime service credit that a state employee has accrued must be determined as of the last day of the preceding month.

           

Subsection (e) adds full-time correctional officers to the explanation of state employees given in this Subsection.

 

Subsection (f) adds full-time correctional officers to the list of state employees that a part-time state employee’s hazardous duty pay shall be proportional to.

 

            Subsection (g) provides that a state employee may not receive more than $10 or $12, as     applicable, for each 12-month period of lifetime service credit regardless of:

                         

(1)    the number of positions the employee holds; or

(2)    the number of hours the employee works each week.

 

Subsection (h) provides that the amount of hazardous duty pay for a particular month for a full-time correctional officer employed by the Texas Department of Criminal Justice is the lesser of:

 

(1)        $12 for each 12-month period of lifetime service credit accrued by the employee; or

(2)        $300.

 

SECTION 2.  This Act takes effect September 1, 2007.

 

EFFECTIVE DATE

 

September 1, 2007.
