BACKGROUND AND PURPOSE

 

Denton County Municipal District No. 6 (the “district”) encompasses an area of land inside the extraterritorial jurisdiction of the City of Aubrey, Texas.    It is necessary to empower the district with authority to subdivide.  HB 2523 provides regulations regarding the division of the district.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

SECTION 1. Amends Chapter 8126, Special District Local Laws Code, by adding Section 8126.107 to read as follows:

 

Sec. 8126.107.  DIVISION OF DISTRICT. 

(a) Provides that the district may be divided into two new districts only if the district:

            (1)  has no outstanding bonded debt; and

            (2)  is not imposing ad valorem taxes.

(b) Provides that the division procedure is prescribed by Sections 53.030 through 53.041, Water Code. 

(c) Provides that any new district created by the division of the district has all the powers and duties of the district.

(d) Provides that any new district created by the division of the district may not contain any land outside the area described by Section 2, Chapter 774, Acts of the 79th Legislature, Regular Session, 2005.

 

SECTION 2.   Effective Date; Upon passage, or, if the Act does not receive the necessary vote, the Act takes effect September 1, 2007.
