AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Under current law, the State Board of Veterinary Medical Examiners (board) is unable to assess the administrative costs of a hearing conducted by the State Office of Administrative Hearings to an individual, even when the individual is found to have violated the Veterinary Licensing Act.

 

H.B. 2585 authorizes the State Board of Veterinary Medical Examiners to assess such administrative costs against individuals who have violated the Veterinary Licensing Act.  The purpose of this bill is to help the board recoup some of its costs so that it may perform its primary duty, protection of public life.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Subchapter I, Chapter 801, Occupations Code, by adding Section 801.411, as follows:

 

Sec. 801.411.  ASSESSMENT OF COSTS.  Authorizes the State Board of Veterinary Medical Examiners to assess a person who is found to have violated this chapter (Veterinarians) the administrative costs of conducting a hearing to determine the violation.

 

SECTION 2.  Makes application of this Act prospective.

 

SECTION 3.  Effective date: upon passage or September 1, 2007.
