BACKGROUND AND PURPOSE

Under current law, the State Board of Veterinary Medical Examiners (Board) is unable to assess the administrative costs of a hearing conducted by the State Office of Administrative Hearings to an individual even though the individual has been found to have violated the Veterinary Licensing Act.  H.B. 2585 would permit the Board to assess such costs against individuals who have in fact violated the Act.

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

HB 2585 amends the Occupations Code by adding section 801.411 to provide that persons found in violation of the Veterinary Licensing Act may have the administrative costs associated with conducting a hearing to establish such violation(s) assessed against them by the State Board of Veterinary Medical Examiners. 

The changes made by this bill apply only to hearings conducted on or after the effective date of this Act.  Hearings conducted before the effective date of this Act are governed by the law in effect on the date the hearing was conducted.

EFFECTIVE DATE

 

Upon passage, or, if the Act does not receive the necessary vote, the Act takes effect September 1, 2007.
