AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Under current law, the Texas Building and Procurement Commission (TBPC) maintains responsibility for providing facility management services for certain Texas Historical Commission (commission) buildings located in the Capitol Complex. The responsibility was placed on TBPC during the 78th Legislature, Regular Session, 2003, as a part of H.B. 3042. TBPC does not maintain adequate skill sets and staffing to meet the unique preservation and historical needs of all these buildings.  However, the commission has staff with specific skill sets related to the historic preservation of facilities.

 

H.B. 2621 transfers the responsibility for providing facility management services to certain buildings located in the Capitol Complex from TBPC to the commission.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 442.0072(d), Government Code, as follows:

 

(d) Requires the Texas Historical Commission (commission) to preserve, maintain in a state of suitable repair, restore, and develop the church and the house, their contents, and their grounds, in the manner determined by the commission, for the beautification and cultural enhancement of the properties as a significant Texas historical site and in a manner consistent with development of the Capitol Complex.

 

SECTION 2.  Amends Subchapter A, Chapter 442, Government Code, by adding Section 442.0073, as follows:

 

Sec. 442.0073.  PRESERVATION AND MAINTENANCE OF CERTAIN STATE BUILDINGS.  (a) Requires the commission to preserve, maintain, and restore Luther Hall, the Elrose Building, and the Christianson-Leberman Building, their contents, and their grounds.

 

(b) Provides the location of said buildings.

 

SECTION 3.  Amends Section 2165.007(b), Government Code, to provide that the Texas Building and Procurement Commission's duty to provide facilities management services does not apply to any property maintained by the commission under Sections 442.0072 and 442.0073.

 

SECTION 4.  Effective date: September 1, 2007.
