AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Currently, the Alcoholic Beverage Code authorizes a holder of a distributor's license to begin delivery and commence sales activity at 5:00 a.m. on any day except Sunday.

 

H.B. 2724 changes the hour that a distributor may begin sales and delivery activity from 5:00 a.m. to 4:00 a.m. in a county with a population of 1.8 million or more people and in any county adjacent to such a county.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Chapter 105, Alcoholic Beverage Code, by adding Section 105.052, as follows:

 

Sec. 105.052.  SALE OF BEER BY DISTRIBUTOR'S LICENSEE IN CERTAIN METROPOLITAN AREAS.  Authorizes the holder of a general, local, or branch distributor's license whose premises is located in a county with a population of 1.8 million or more or in a county adjacent to a county with a population of 1.8 million or more to sell, offer for sale, or deliver beer beginning at 4 a.m. on any day except Sunday in addition to the hours specified for the sale of beer in Section 105.05(b).

 

SECTION 2.  Effective date: upon passage or September 1, 2007.
