BACKGROUND AND PURPOSE

 

Currently, the Alcoholic Beverage Code authorizes a distributor licensee to begin delivery and commence sales activity at 5 a.m. on any day, except Sunday. 

 

H.B. 2724 would change the hour that a beer distributor could begin sales and delivery activity to 4 a.m. in a county with a population of 1.8 million or more or in a county adjacent to that county.

 

RULEMAKING AUTHORITY

 

It is the committee’s opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. 

 

ANALYSIS

 

H.B. 2724 amends Subchapter B, Chapter 105, Alcoholic Beverage Code, by adding Sec. 105.052 to authorize a holder of a general, local, or branch distributor's license whose premise is located in a county with a population of 1.8 million or more or in a county adjacent to that county to sell, offer for sale, or deliver beer beginning at 4 a.m. on any day, except Sunday.

 

EFFECTIVE DATE

 

Immediately, or, if the Act does not receive the necessary vote, the Act takes effect September 1, 2007.
