AUTHOR'S / SPONSOR'S STATEMENT OF INTENT
Current law permits only historically underutilized businesses (HUB) program participants to use the participation of "small businesses" as a criteria in "best value" procurements criteria. Dallas-Forth Worth Airport (DFW Airport) is unable to use this additional evaluation criteria because it is a small and emerging business program, rather than a HUB program.
H.B. 2749 authorizes DFW Airport to use the participation of "small businesses" as additional evaluation criteria in its "best value" procurements.
RULEMAKING AUTHORITY
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Section 252.043, Local Government Code, by adding Subsection (b-1), as follows:
(b-1) Authorizes a joint board created for the purpose of public agencies acting jointly for purposes of Chapter 22 (County and Municipal Airports), Transportation Code, and described by Section 22.074(d) (regarding a joint board of which the constituent agencies of the board are populous home-rule municipalities), Transportation Code, that awards contracts in the manner provided under this chapter (Purchasing and Contracting Authority of Municipalities), in addition to the considerations provided under Subsection (b), to consider in determining the best value for the board the impact on the ability of the board to comply with laws, rules, and programs relating to contracting with small businesses, as defined by the size standards of the United States Small Business Administration for all for-profit industries.
SECTION 2. Effective date: upon passage or September 1, 2007.
