AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Due to the large number of municipal utility districts (MUDs) in Harris County, legislation was enacted to exempt MUDs from using the county precincts as their election precincts for November elections.  That legislation remedied a problem that Harris County was experiencing with the growing amounts of MUDs.  However, the same legislation exempted school districts, entities that have a very close relationship with counties and all of their elections.

 

H.B. 2926 removes the bracket exemption to require school districts in Harris County to use county election precincts for November elections.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 42.002(a), Election Code, to provide that the county election precincts are the election precincts for any other election held on the November uniform election date of a school district located in any county, as provided by Section 42.0621 (Precincts for November Election).  Makes nonsubstantive changes.

 

SECTION 2.  Amends Section 42.0621(a), Election Code, to require the political subdivisions described by Section 42.002(a)(5), rather than the participating political subdivisions not located in a county with a population of more than 3.3 million or a county adjacent to a county with a population of more than 3.3 million, to use the regular county election precincts in an election held on the November uniform election date.

 

SECTION 3.  Amends Section 43.004(b), Election Code, to require a political subdivision that holds an election on the November uniform election date and is required to use the regular county election precincts, rather than a political subdivision not located in a county with a population of more than 3.3 million or a county adjacent to a county with a population of more than 3.3 million that holds an election on the November uniform election date, to designate as the polling places for the election the regular county polling places in the county election precincts that contain territory from the political subdivision.

 

SECTION 4.  Effective date: September 1, 2007.
