BACKGROUND AND PURPOSE
Under current law, to be a supervisor of a fresh water supply district a person must be a registered voter of the district. However, in many cases a fresh water supply district is created for an uninhabited area in which most of the land is owned by a developer who does not live in the proposed district but plans to develop the land. To address this issue, H.B. 2984 amends the qualifications for supervisors of fresh water supply districts and matches the qualifications with those set forth for directors of water control and improvement districts and municipal utility districts.
RULEMAKING AUTHORITY
It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.
ANALYSIS
Section 53.063,Water Code, is amended to provide that a person must be a resident of this state, the owner of taxable property in the district, and at least 18 years of age to be qualified for election as a supervisor of a fresh water supply district. This change in law does not affect the eligibility of a person serving as a supervisor on the effective date of this act to serve the remainder of the person's term.
EFFECTIVE DATE
September 1, 2007
