BACKGROUND AND PURPOSE

 

Currently, State law defines the number of persons who may be appointed to the classification immediately below the department head in a police department covered by municipal civil service.  This law restricts some police department's ability to meet its growing demands.

 

House Bill No. 2995 benefits police departments by allowing for an increase in the number of persons appointed.

 

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a State officer, institution, department or agency.

 

 

SECTION-BY-SECTION ANALYSIS

 

SECTION 1 would amend Section 143.014(c), Local Government Code by changing the date from 1983 to 2007.  It also makes conforming changes to reference Chapter 174 instead of The Fire and Police Employee Relations Act (Article 5154c-1, Vernon's Texas Civil Statutes).

 

SECTION 2 provides the effective date which is upon passage with 2/3 vote of the members of each chamber or September 1, 2007.
