AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Under current law, the occupational regulation of water treatment specialists and their job duties, such as water softener or water treatment installation, is provided in both the Health and Safety Code and the Occupations Code.

 

H.B. 3017 transfers Health and Safety Code provisions relating to water treatment specialists to the Occupations Code and redesignates the provisions as Chapter 1904, Occupations Code.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Transfers Subchapter G, Chapter 341, Health and Safety Code, to Subtitle A, Title 12, Occupations Code, redesignates as Chapter 1904, Occupations Code, and amends, as follows:

SUBCHAPTER A.  GENERAL PROVISIONS

 

Sec. 1904.001.  DEFINITIONS.  Redesignated from existing Section 341.101, Health and Safety Code.  Makes a conforming change.

SUBCHAPTER B.  CERTIFICATION REQUIREMENTS

 

Sec. 1904.051.  WATER TREATMENT SPECIALIST CERTIFICATION PROGRAM.  Redesignated from existing Section 341.102, Health and Safety Code.

 

Sec. 1904.052.  CERTIFICATION REQUIRED.  Redesignated from existing Section 341.103, Health and Safety Code.  Makes a conforming change.

 

Sec. 1904.053.  APPLICATION FOR CERTIFICATION.  Redesignated from existing Section 341.104, Health and Safety Code.  Makes a conforming change.

 

Sec. 1904.054.  ISSUANCE OF CERTIFICATE.  Redesignated from existing Sections 341.105(a) and (b), Health and Safety Code.

 

Sec. 1904.055.  EXEMPTIONS.  (a)  Redesignated from existing Section 341.105(c).  Makes conforming changes.

 

(b)  Redesignated from existing Section 341.105(d), Health and Safety Code.  Makes a conforming change.
