BACKGROUND AND PURPOSE

 

Under current law, the occupational regulation of water treatment specialists and their job duties, i.e. water softener or water treatment installation, is described in both the Health and Safety Code and the Occupations Code. 

 

References to water treatment specialists in both codes have caused varying interpretation among municipalities across the state.  H.B. 3017 transfers Health and Safety Code provisions relating to water treatment specialists to the Occupations Code, re-designating the provisions as Chapter 1904.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

SECTION 1.  Subchapter G, Chapter 341, Health and Safety Code, is transferred to Title 12, Occupations Code, re-designated as Chapter 1904, Occupations Code, and amended as follows:
 

Chapter 1904. WATER TREATMENT SPECIALISTS. Provides a separate chapter designation for water treatment specialists providing general provisions and certification requirements.

 

SUBCHAPTER A. GENERAL PROVISIONS. Transfers Subchapter G, Chapter 341, Health and Safety Code to Chapter 1904 of the Occupations Code.

 

Sec. 1904.001. DEFINITIONS. Transfers Subchapter G, Chapter 341, Section 341.101 of the Health and Safety Code to Section 1904.001.  Chapter replaces the word subchapter.

 

(1)   – (4) Sets forth definitions relating to water treatment specialists. 

 

SUBCHAPTER B. CERTIFICATION REQUIREMENTS.  Creates new subchapter for certification of water treatment specialists.

 

Sec. 1904.051 Transfers Subchapter G, Chapter 341, Section 341.102 of the Health and Safety Code to Chapter 1904, Section 1904.051 of the Occupations Code.

 

Sec. 1904.052. CERTIFICATION REQUIRED. Transfers Subchapter G, Chapter 341, Section 341.103 of the Health and Safety Code to Chapter 1904, Section 1904.052 of the Occupations Code.  Chapter replace the word subchapter.

 

Sec. 1904.053. APPLICATION FOR CERTIFICATION. Transfers Subchapter G, Chapter 341, Section 341.104 of the Health and Safety Code to Chapter 1904, Section 1904.053 of the Occupations Code.  Chapter replaces the word subchapter.

 

Sec. 1904.054. ISSUANCE OF CERTIFICATE. Transfers Subchapter G, Chapter 341, Section 341.105 of the Health and Safety Code to Chapter 1904, Section 1904.054 of the Occupations Code.

 

Sec. 1904.055. EXEMPTIONS. Transfers Subchapter G, Chapter 341, Section 341.105 (c) – (d) of the Health and Safety Code to Chapter 1904, Section 1904.055 (a) – (b) of the Occupations Code.  Chapter replaces the word subchapter.  Deletes a reference to the Occupations Code.

 

SECTION 2.  Effective Date:  Upon passage, or, if the Act does not receive the necessary vote, the Act takes effect September 1, 2007.
