AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Currently, visiting judges serving at the appellate or county court at law level  receive the same salary as the judges in those courts.  Visiting judges in district courts, however, receive 85 percent of the salary of the regular district court judges.

 

H.B. 3135 changes the rate of pay for visiting judges in district courts to equal that of the regular district court judges.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Sections 74.061(h) and (i), Government Code, as follows:

 

(h) Provides that the salary from the state of a retired judge or justice assigned to a district court, notwithstanding Subsection (c), is determined pro rata on the sum of the regular judge's salary from the county plus the greater of the regular judge's salary from the state on August 31, 2007, rather than 1997, or 100 percent, rather than 85 percent, of the regular judge's salary from the state, as established by the General Appropriations Act for any fiscal year.  Makes a conforming change.

 

(i) Makes conforming changes.

 

SECTION 2.  Makes application of this Act prospective.

 

SECTION 3.  Effective date: September 1, 2007.
