AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

H.B. 3182 creates the Tradition Municipal Utility District No. 2 of Denton County (district), providing this district with the authority to impose a tax and issue bonds.  This bill grants the district a limited power of eminent domain.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Subtitle F, Title 6, Special District Local Laws Code, by adding Chapter 8189, as follows:

 

CHAPTER 8189.  TRADITION MUNICIPAL UTILITY DISTRICT NO. 2 OF            DENTON COUNTY

 

Sets forth standard language for the creation of the Tradition Municipal Utility District No. 2 (district) in Denton County.  Sets forth standards, procedures, requirements, and criteria for:

 

Creation and approval of the district (Sections 8189.001 - 8189.020);

 

Size, composition, election, and terms of the board of directors of the district (Sections 8189.021 - 8189.100);

 

Powers and duties of the district (Section 8189.101 - 8189.150);

 

Division of the district into multiple districts (Sections 8189.103 – 8189.108); and

 

General financial provisions and authority to impose taxes and issue bonds and obligations for the district (Sections 8189.151 - 8189.201).

 

Authorizes the district to exercise the power of eminent domain outside the district only to acquire an easement necessary for pipeline, storm water, or drainage facilities that serve the district (Section 8189.109).

 

SECTION 2.  Sets forth the initial boundaries of the district.

 

SECTION 3.  Provides that all requirements of the constitution and the laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished.

 

SECTION 4.  Effective date: September 1, 2007.
