BACKGROUND AND PURPOSE
Current law provides that the driving record of candidates for school bus operators be evaluated and provides for eligibility standards. Many serious offenses such as driving under the influence of alcohol and drugs, aggravated assault with a motor vehicle, and murder with a motor vehicle result in a seven year wait period before these people are eligible to drive school buses.
CSHB 3190 changes this required seven year wait period to ten years to enhance evaluation and opportunities for rehabilitation.
RULEMAKING AUTHORITY
It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.
ANALYSIS
CSHB 3190 amends the Transportation Code Section 521.022 Subsection (d) to increase the minimum standards for school bus operators. This bill would require the Department of Transportation to prohibit individuals from operating a school bus who been convicted of the offenses under Sections 49.04, 49.045, 49.07, or 49.08 of the Penal Code within ten years preceding the person's driver's record check.
EFFECTIVE DATE
Upon passage, or, if the Act does not receive the necessary vote, the Act takes effect September 1, 2007.
