BACKGROUND AND PURPOSE

 

Current law permits investigators appointed by prosecuting attorneys to serve arrest warrants, subpoenas and all other process issued by certain courts in criminal cases. The purpose of the bill is to extend this authority to civil process.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

The bill would amend the Government Code by adding civil cases as an additional category of cases for which an investigator appointed by a prosecuting attorney has authority to serve process issued by a district court, county court or justice court in this state.

 

EFFECTIVE DATE

 

Immediately on receipt of required vote; otherwise September 1, 2007.
