BACKGROUND AND PURPOSE
The district lines of Blinn Junior College and Austin Community College are drawn so that students in certain school districts may be divided among different community colleges. CSHB 3236 seeks to change the district lines of Blinn Junior College and Austin Community College to remedy these overlaps.
RULEMAKING AUTHORITY
It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.
ANALYSIS
SECTION 1: Section 130.166 of the Education Code is amended to add additional language, eliminate existing language, and make conforming changes relating to the Austin Community College District service area. Removes Bastrop County and adds Lexington independent school district to the Austin Community College District service area. Bastrop County except the territory within the Lexington In dependent School District is included in the Austin Community College District service area. The part of the Elgin Independent School District located in Lee County and the part of Smithville Independent School District located in Fayette County are included in the Austin Community College District service area.
SECTION 2: Section 130.168 of the Education Code is amended to eliminate existing language and add additional language relating to the Blinn Junior College District Service Area. Removes Lee and Fayette counties from the service area. Fayette County except the territory within Smithville Independent School District is included in the service area. Lee County except the territory within the Elgin Independent School District is included and it includes the part of Lexington Independent School District that is located in Williamson, Milam and Bastrop Counties in the service area.
SECTION 3: The change in law made by this Act applies beginning with the 2007 fall semester, except that during the 2007-2008 academic year, the Austin Community College District and the Blinn Junior College District each may continue to treat the areas removed by this Act from the applicable district's service area as if the areas were still in the district's service area as necessary to avoid an unreasonable interruption of junior college services in the area.
SECTION 4: Effective date.
EFFECTIVE DATE
Upon passage, or, if the Act does not receive the necessary vote, the Act takes effect September 1, 2007.
COMPARISON OF ORIGINAL TO SUBSTITUTE
The substitute adds SECTIONS 2 and 4 and makes SECTION 1 the Austin Community College District Area and SECTION 2 the Blinn Junior College District Area. The substitute lays out SECTION 1 with no changes to the Austin Community College Service area. The substitute lays out SECTION 2 changing the order of the included/excluded parts of the Blinn Junior College District Service Areas.
