BACKGROUND AND PURPOSE

 

Subchapter F of Chapter 26, Insurance Code establishes the Texas Health Reinsurance System (System), which provides small employer health insurance carriers the ability to reinsure risks covered under small employer health benefit plans.  The System operates like a reinsurer and spreads its aggregate loss among its member carriers. 

 

House Bill 3252 extends the duration of provisions of the Texas Health Reinsurance System to September 1, 2009.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

SECTION 1.   Amends Section 1501.3241, Insurance Code, to provide that this section expires September 1, 2009.

 

SECTION 2.   Amends Subsections (d-1) and (e-1), Section 1501.325, Insurance Code, to provide that the respective subsections expire September 1, 2009.

 

SECTION 3.   Effective date: upon passage or September 1, 2007.

 

EFFECTIVE DATE

 

Upon passage, or, if the Act does not receive the necessary vote, the Act takes effect September 20, 2007.
