BACKGROUND AND PURPOSE

 

Subchapter B, Chapter 67, Water Code, was enacted by SB 1811 in the 79th session to authorize the dissolution of a water supply corporation that is no longer able to conduct corporate business, and to permit a municipality to acquire the assets and customer service obligations. This legislation was bracketed to assist El Paso Water Utilities in acquiring the Ponderosa and Western Village Water Supply Corporation. Since the enactment of Subchapter B, El Paso Water Utilities has initiated proceedings for the acquisition of the water supply corporation.      C.S.H.B. 3353 repeals Subchapter B because it is no longer necessary, but includes a saving provision that continues to provide El Paso Water Utilities with the legal authority necessary to complete the acquisition.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

SECTION 1.  Repeals Subchapter B, Chapter 67, Water Code.

 

SECTION 2.  Provides that the repeal of Subchapter B does not apply to any action by a municipality that has been initiated prior to the repeal of Subchapter B such that the law continues in effect for that transaction until completed by the municipality.

 

SECTION 3.  Provides an effective date of September 1, 2007.

September 1, 2007.
