BACKGROUND AND PURPOSE

 

Currently, tourist-oriented directional signs may be placed on a noncontrolled-access highway outside a town with a population of 5,000 or more.  This regulation mirrors current federal regulations.  However, it is anticipated that the federal regulations may be expanded.

 

C.S.H.B. 3441 amends the Transportation Code to simply allow the state requirements for sign placement to mirror the federal requirements.  Should the federal requirements change, legislation would not be needed to change the state requirements.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

SECTION 1.   Amends Section 391.099(a)(2) of the Transportation Code to allow for the adoption of rules relating to the placement of tourist-oriented directional signs that meet the requirements of all applicable federal laws, regulations, and guidelines.

 

SECTION 2.   Effective date.

 

EFFECTIVE DATE

 

Upon passage, or, if the Act does not receive the necessary vote, the Act takes effect September 1, 2007.
