AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

H.B. 3549 increases the security fees charged to defendants convicted of certain offenses.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to any state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Articles 102.017(a) and (b), Code of Criminal Procedure, as follows:

 

(a) Requires a defendant convicted of a felony offense in a district to pay a $10, rather than $5, security fee as a cost of court.

 

(b) Requires a defendant convicted of a misdemeanor offense in a justice court to pay an $8, rather than $4, security fee as a cost of court.

 

SECTION 2.  Amends Section 102.041, Government Code, as follows:

 

Sec.  102.041.  ADDITIONAL COURT COSTS ON CONVICTION IN DISTRICT COURT.  Requires the clerk of the district court to collect a security fee from a defendant convicted on a felony offense of $10, rather than $5.

 

SECTION 3.  Reenacts and amends Section 102.101, Government Code, as amended by Chapter 240 and 949, Acts of the 79th Legislature, Regular Session, 2005, as follows:

 

Sec.  102.101.  ADDITIONAL COURT COSTS ON CONVICTION IN JUSTICE COURT.  Requires the clerk of the district court to collect a security fee from a defendant convicted on a misdemeanor offense of $8, rather than $3.

 

SECTION 4.  Makes application of this Act prospective.

 

SECTION 5.  Effective date:  September 1, 2007.
