AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Current law allows for the disposition of surplus state property, but not specifically for the transfer of a parcel of land to the City of Winnsboro. 

 

The Texas Department of Criminal Justice (TDCJ) currently owns approximately 365 acres in Wood County located adjacent to the City of Winnsboro's municipal airport.  As part of its long range plan, the City of Winnsboro needs to expand the runway for the airport, which will require acquiring approximately 25 acres from TDCJ.  This acreage is unused by TDCJ.

 

H.B. 3688 directs a transfer of the property from TDCJ to the City of Winnsboro no later than October 31, 2007. 

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  (a)  Requires the Texas Department of Criminal Justice (TDCJ), not later than October 31, 2007, to transfer to the City of Winnsboro, for consideration to which the parties mutually agree, the real property described by Subsection (d) of this section.

 

(b)  Authorizes the consideration for the transfer authorized by Subsection (a) of this section to be in the form of an agreement between the parties that requires the City of Winnsboro to use the property for a purpose that benefits the public interest of the state.  Authorizes the City of Winnsboro, if the consideration for the transfer is in the form of an agreement described by this subsection, to use the property transferred under this Act only for a purpose that benefits the public interest of the state; and ownership of the property automatically reverts to TDCJ if the City of Winnsboro no longer uses the property for a purpose that benefits the public interest of the state.

 

(c)  Requires TDCJ to transfer the property by an appropriate instrument of transfer.  Requires the instrument of transfer, if the consideration for the transfer is in the form of an agreement described by Subsection (b) of this section, to include a certain provision.

 

(d)  Sets forth the real property boundaries to which Subsection (a) of this section refers, which consists of two tracts of land.

 

SECTION 2.  Effective date: upon passage or September 1, 2007.
