BACKGROUND AND PURPOSE

 

The Texas Department of Criminal Justice (TDCJ) currently owns approximately 365 acres in Wood County located adjacent to the City of Winnsboro's municipal airport.  As part of its long range plan, the City of Winnsboro needs to expand the runway for the airport, which will require acquiring approximately 25 acres from TDCJ.  This acreage is unused by TDCJ, and C.S.H.B. 3688 will provide for a transfer of the property from TDCJ to the City of Winnsboro no later than October 31, 2007. 

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

C.S.H.B. 3688 requires that not later than October 1, 2007, the Texas Department of Criminal Justice (Department) will transfer to the City of Winnsboro            (City), the real property described in Subsection (d).  The parties must mutually agree on the terms of the transfer, and the City is required to use the property for a public use.  If the City does not use the property for a public use, the property reverts back to the Department.  These terms are also to be included in any agreement between the parties.

 

EFFECTIVE DATE

 

Upon passage, or, if the Act does not receive the necessary vote, the Act takes effect September 1, 2007.

 

COMPARISON OF ORIGINAL TO SUBSTITUTE

 

The substitute replaces the original language describing the land to be transferred with a legal description of the land to be transferred.
