BACKGROUND AND PURPOSE

 

In 2003, the Texas Legislature separated the provisions in Chapter 43, Subchapter F, of the Local Government Code concerning limited-purpose annexations from the provisions in Section 43.0751 of the Local Government Code concerning limited-purpose annexations pursuant to strategic partnership agreements.  The voting rights of residents in limited-purpose areas are defined in Subchapter F. 

 

C.S.H.B. 3723 will clarify the intent of the voting rights of citizens residing in areas annexed for limited purposes pursuant to a strategic partnership agreement.  This bill would make it plain that the residents in an area annexed for limited purposes pursuant to a strategic partnership agreement under Section 43.0751 of the Local Government Code are entitled to the same voting rights as residents of an area annexed for limited purposes under Subchapter F of Chapter 43 of the Local Government Code. 

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution.

 

ANALYSIS

 

C.S.H.B. 3723 amends Section 43.0751(q), Local Government Code to read as follows:

 

Except for Sections 43.130(a) and (b), Subchapter F does not apply to a limited-purpose annexation under a strategic partnership agreement.

 

EFFECTIVE DATE

 

Upon passage, or, if the Act does not receive the necessary vote, the Act takes effect September 1, 2007.

 

COMPARISON OF ORIGINAL TO SUBSTITUTE

 

C.S.H.B. 3723 corrects a technical error which specifies that only Sections 43.130(a) and (b) of the Local Government Code applies to a limited-purpose annexation under a strategic partnership agreement.
