AUTHOR'S / SPONSOR'S STATEMENT OF INTENT
Current statute requires the board of trustees of the firefighters retirement system to deliver a certificate of service upon retirement of the member. However, such certificates are not being delivered.
H.B. 3731 deletes existing text in the Texas Local Fire Fighters Retirement Act requiring the board of trustees of the retirement system to issue to a retiring member a certificate of service. This bill also makes certain technical changes.
RULEMAKING AUTHORITY
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Section 13, Texas Local Fire Fighters Retirement Act (Article 6243e, V.T.C.S.), as follows:
Sec. 13. (a) Makes no change to this subsection.
(b) Deletes existing text requiring the board of trustees of the firefighters retirement system and trust fund of which the person is a member to issue to the member a certificate of service, stating the completion of the service requirement and certifying that the member is entitled to applicable service retirement benefits on attaining the applicable age, whether or not the member performs service after the date of the issuance of the certificate on termination of employment or other discontinuance of service of a person described by Subsection (a) of this section. Deletes existing text requiring the certificate to state that the entitlement is conditioned on the member's leaving contributions in the retirement system.
(c) Redesignates this subsection as Subsection (b).
SECTION 2. Amends Section 19(b), Texas Local Fire Fighters Retirement Act (Article 6243e, V.T.C.S.), as follows:
(b) Requires a person to be a participating member, rather than a member, of the retirement system to be elected a member of a board of trustees under this subsection.
SECTION 3. Redesignates Section 21A(h), Texas Local Fire Fighters Retirement Act (Article 6243e, V.T.C.S.), as enacted by Chapter 327, Acts of 77th Legislature, Regular Session, 2001, as Subsection (h-1).
SECTION 4. Effective date: upon passage or September 1, 2007.
