BACKGROUND AND PURPOSE
The Texas Local Fire Fighters Retirement Act, enacted in 1937, has been amended throughout the years to meet the needs of the pension systems.
This bill is the latest in the series of needed revisions, and includes renumbering a section that was overlooked in previous corrective legislation.
RULEMAKING AUTHORITY
It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.
ANALYSIS
This bill amends the Texas Local Fire Fighters Retirement Act to delete outmoded language, resolve conflicting language, and correct a duplicate subsection reference.
This bill applies to paid, partly paid, and volunteer fire departments that operate under the Texas Local Firefighter's Retirement Act.
This bill removes the provision that requires the board of trustees of a retirement plan to issue a certificate of service to a member that is terminated or discontinues service.
The bill specifies that to be an elected a member to the board of trustees a person must be a participating member of the retirement system.
EFFECTIVE DATE
Upon passage, or, if the Act does not receive the necessary vote, the Act takes effect September 1, 2007.
