AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

The Texas rail relocation and improvement fund was created through the enactment of H.B. 1546 by the 79th Legislature, Regular Session, 2005, and a constitutional amendment that was approved by voters later that year.  However, there have not been any appropriations made to establish this fund.  Providing for such appropriations may lead to rail improvement and the production of certain benefits for the private and public sector. 

 

H.B. 3747 authorizes the Texas Department of Transportation to expend general revenue funds appropriated to the Texas rail relocation and improvement fund. 

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 91.071(b), Transportation Code, to create an exception authorizing the Texas Department of Transportation to spend from the general revenue fund to implement this chapter (Rail Facilities) money appropriated to the Texas rail relocation and improvement fund. 

 

SECTION 2.  Effective date: upon passage or September 1, 2007.
