BACKGROUND AND PURPOSE

 

The Texas Enterprise Fund was established during the 78th Legislative Session to allow the state to respond quickly and aggressively to opportunities for special development projects in Texas which demonstrate a significant return on the state's investment.  H.B. 3749 recognizes rail relocation and development as an appropriate project for an Enterprise Fund grant.

 

H.B. 3749 would authorize the Governor to make an award of Texas Enterprise Funds to the Texas Department of Transportation for purposes of building, relocating or purchasing a rail facility under Chapter 91 of the Transportation Code. 

 

RULEMAKING AUTHORITY

 

It is the opinion of the committee that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

SECTION 1.  Amends Section 481.078, Government Code, by adding Subsection (k), which allows the Texas Enterprise Fund to be used to make one or more grants to the Texas Department of Transportation to carry out its powers and duties relating to rail facilities under Chapter 91 of the Transportation Code.

 

SECTION 2.  Amends Section 91.071(b), Transportation Code, to prohibit the Texas Department of Transportation from spending money from the general revenue fund except to implement this chapter, or pursuant to a line-item appropriation.

 

SECTION 3.  States the effective date for this Act.

 

EFFECTIVE DATE

 

Upon passage, or, if the Act does not receive the necessary vote, the Act takes effect September 1, 2007.
