AUTHOR'S / SPONSOR'S STATEMENT OF INTENT
In January 2006, the South Central Regional Water Planning Group (Region L) failed to adopt its 2006 Regional Water Plan by the statutory deadline and submit that plan to the Texas Water Development Board (TWDB) for approval and inclusion in the 2007 State Water Plan. There is no flexibility or discretion in the statute to allow for Region L to submit its adopted plan to TWDB after the deadline.
H.B. 3776 is narrowly drafted to allow the water plan adopted by Region L to be submitted to TWDB.
RULEMAKING AUTHORITY
This bill does not expressly grant any additional rulemaking authority to any state officer, institution, or agency.
SECTION BY SECTION ANALYSIS
SECTION 1. Authorizes the Texas Water Development Board (TWDB), notwithstanding Section 16.053(i) (relating to the regional water planning groups submitting their adopted regional water plans for approval and inclusion in the state plan, and revised regional plans) Water Code, to approve and include in the state water plan for the five-year period beginning January 5, 2007, the regional water plan that was submitted to TWDB by the Region L regional water planning group.
(b) Authorizes TWDB to approve the regional water plan for Region L only if it makes certain changes to the plan.
(c) Requires TWDB to amend the state water plan for the five-year period beginning January 5, 2007, as necessary to conform to the requirements of this Act.
SECTION 2. Effective date: upon passage or September 1, 2007.
