BACKGROUND AND PURPOSE

 

Texas residents serving overseas have died in combat areas. The purpose of this bill is to exempt their estates from fees ordinarily associated with filing their wills or other probate services.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

The bill would add a new section to the Probate Code which would provide a probate fee exemption for estates of decedents who died in a combat zone designated as such by the President of the U.S. under federal law.

 

EFFECTIVE DATE

 

Immediately on receipt of required vote; otherwise September 1, 2007.
