BACKGROUND AND PURPOSE

 

Current law places certain restrictions on holders of Class A, B, or C driver’s licenses when the person is under 18 years of age.  While the restrictions do not apply to the holder of a hardship license, they do apply following the issuance of an original Class A, B, or C license. 

 

H.B. 3854 seeks to end this inconsistency by removing the restrictions for those who have held a hardship license prior to receiving their original Class A, B, or C license.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

SECTION 1. Amends Section 545.424(c), Transportation Code to provide that the section does not apply to a person who held a hardship license immediately preceding the issuance of an original Class A, B, or C driver’s license to the person.

 

SECTION 2. Provides that this Act takes effect immediately if it receives a vote of two-thirds of all members elected to each house, as provided by Section 39, Article III, Texas Constitution.  If this Act does not receive the vote necessary for immediate effect this Act takes effect September 1, 2007.

 

EFFECTIVE DATE

 

Upon passage, or, if the Act does not receive the necessary vote, the Act takes effect September 1, 2007.
